Special Auction Terms for Buyers
(Applicable to this auction – complementing the General Terms and Conditions of Surplex GmbH)

1. Viewing and Safety
Buyers and their representatives may inspect the goods during the viewing period announced by Surplex GmbH.
All visitors must comply with site-specific safety rules and instructions issued by Surplex GmbH or the site operator.
Access is at visitors’ own risk. PPE is mandatory. Entry requires a permit from the seller due to customs supervision.
Surplex GmbH and the Seller are not liable for injuries or damages during inspections.

2. Allocation Period and Binding Bids
An allocation period of 72 working hours applies after auction close for the Seller to confirm the highest bids.
During this time, bids remain binding and irrevocable.
Successful Buyers will be notified by Surplex GmbH upon Seller confirmation.

3. Collection and Safety
Unless stated otherwise, dismantling, loading, and transport are the Buyer's responsibility.
Collection is allowed only after full payment and within the official collection period.
Standard collection deadline: 30 days after payment receipt.
For the crane: 75 days after payment receipt.
Buyers and their contractors must follow site access and safety rules. PPE is required.
Non-collection within the period incurs storage fees per Luka Koper’s price list.
If not collected within 10 working days post-deadline, goods may be deemed abandoned and disposed of at the Buyer’s cost, with no refund.

4. Specific Collection Procedure – Luka Koper Terminal
1. Delivery Note: Buyer must sign after inspecting equipment.
2. Condition Acknowledgement: Luka Koper confirms to Surplex that equipment was accepted as advertised.
3. Payment Order: Issued upon confirmation. Payment due within 3 working days.
4. Pre-Collection: Preparations allowed; no item may leave before Surplex confirms payment.
5. Condition Guarantee: Luka Koper guarantees condition from Delivery Note to handover. Report discrepancies immediately.
6. Buyer Notification: Buyers are pre-informed of procedures and Luka Koper site terms.

5. Governing Law and Miscellaneous
These Special Terms are governed by Slovenian law.
Jurisdiction: Courts of Koper, Slovenia.
Surplex GmbH reserves the right to correct errors or modify terms for operational/safety reasons.
In case of conflict with General Terms, these Special Terms prevail.
